ties and investigators are doing are interviewing witnesses. again, as we mentioned earlier, they do not have a suspect description. but we do know about the victim. he has relatives in the marin city area. we spoke to a woman earlier who identified herself as his sister. she says that he is from weed, california, and went to weed high school and he just turned 17 four days ago. sheriff's deputies tell me they expect to be here throughout the morning. authorities say they believe this is an isolated incident. there should be no concern to the public. again, this is still an ongoing investigation and we will bring you the latest as we have it. reporting live from marin city, cate caugiran, cbs 5. some frosty foliage out there expected in the next few days anyways because we are in the middle of a cold snap. we are also seeing freeze warnings in effect right now. the warning is in effect for north bay valleys until 8:00 this morning. a frost advisory is issued for the south bay. in livermore, people bundled up

for unseasonably chilly temperatures. >> i am all bundled up. i have my alpaca mittens. there's not a lot of precipitation in the air so it makes it colder. >> whole new wardrobe out there. elizabeth will have more on the bay area chill coming up in just a couple of minutes. snow, wind and cold weather hits southern california. wintry conditions forced the chp to shut down the grapevine section connecting los angeles to the central valley. that set off major traffic delays for miles. the area saw several accidents and spinouts in the mountain pass yesterday. if you aren't used to driving in the weather -- >> the grapevine is a little tricky. you're heading to l.a. and you will of a sudden you get to 3,000 -- and all of a sudden you get to 3,000 feet and you're like, wait a minute, you have snow. >> dusting in the santa cruz mountains, santa lucia mountains of monterey county got up to 6" so some areas a little farther south got some snow. we got some rain yesterday in the bay area. now our high-def doppler radar is taking a break.

it's all about the cold weather for the next couple nights. notice that flag there blowing in the breeze? it's windy. so the winds have kept temperatures slightly warmer than we initially forecast. not seeing any 20s out there yet but that could change closer to sunrise and if the winds die down. so we are going to monitor the temperatures over the next couple of hours. so right now we are seeing 30s and very low 40s across the bay area. now, that freeze warning and frost advisory is still in effect in the bay area until 8:00. the temperatures could dip into the 20s. so we'll keep a close eye. in the meantime, back to you guys. president obama will discuss the withdrawal of u.s. troops from afghanistan with president hamid karzai today. he made the rounds in washington this week including dinner with secretary of state hillary clinton. an afternoon news conference is set after discussions on the future u.s. role in afghanistan. white house officials say the

president will not announce any decisions whether any u.s. forces will stay behind after the war formally ends in 2014. don't look now but california is steaming toward a budget surplus maybe for the foreseeable future, too. governor brown released his $145 billion budget yesterday complete with an $851 million surplus. schools are the big winners. k-12 and community colleges get an extra $3 billion. medi-cal gets an extra $350 billion and a billion will go into the rainy day fund. the key is to hold the line now on spending, governor brown says. >> what i think is compassionate, what is good for the state of california, and what we can maintain over time instead of just enjoying a momentary high and then having the hangover many years later. >> the bad news, california still has a mountain of debt to pay back after back after

borrowing during the down years. boeing 787 dreamliner has had a turbulent week. the faa ordered a review of the aircraft. cbs 5 reporter anne makovec at the airport where the aircraft is scheduled to land in san jose this morning. >> reporter: good morning. these new concerns about the 787 could mar the celebration here. as of now, this nonstop flight to tokyo still scheduled to leave here from san jose at 11:45 a.m. this is the first boeing 787 dreamliner aircraft to fly from the bay area. it's run by all nippon airways from japan. this model has been flying for a year. the faa this morning ordered a comprehensive review of critical systems in this particular model after a fire and fuel leak this week, also some reports of cracked windshields. several flights had to be canceled. this is video from boston'

logan airport. cbs aviation analyst chesley sullenberger says it's common to be working out kinks. >> no matter how much testing you do there are some things that are inevitably discovered during the real world of operational airline flying. >> reporter: this thing is state-of-the-art and relies more than any other modern airliner on electrical systems to help power the plane. it's also the first boeing plane to use rechargeable lithium ion batteries and made with lightweight materials. the price tag, $207 million. so if all goes well with today's flight, it is set to land tomorrow in japan at 4:10 p.m. live at mineta san jose airport, anne makovec, cbs 5. a central california teacher is being hailed as a hero after he stopped a student from going on a shooting rampage. a 16-year-old opened fire in a classroom at taft union high school in kern county. that's about 100 miles north of los angeles. the teen struck a fellow student and that's when ryan

heber a teacher in the classroom started talking to the shooter and convinced him to back down. >> i think at one point he made the statement he didn't want to shoot the teacher and ultimately he put the shotgun down. >> police are investigating reports that the suspect was in trouble at school last year because he allegedly had a hit list. investigators say the gunman said he has been bullied by a couple of students. the victim is in stable condition. 5:07. this morning the vice president joe biden will talk to video game makers for factors that may contribute to violent behavior. yesterday he talked to the national rifle association. the nra said it will not allow law-abiding gun owners to be blamed for the acts of criminals. colorado movie theater shooting suspect facing arraignment today. a judge ruled there is enough evidence for james holmes to go on trial on all 166 counts against him. however, his lawyer says they

are not ready to enter a plea yet for their client. holmes is accused of killing 12 people and injuring 70 others in the shooting last summer. bay area headlines now. in san jose, school officials are trying to figure out how and why three suspected gang members walked on campus and started beating up one of the students. it happened wednesday at pioneer high. a school staff member eventually broke the fight up by using pepper spray. the student was not badly hurt. san francisco man accused of setting his girlfriend on fire has pleaded not guilty. 22-year-old dexter oliver faces 11 felony charges including attempted murder, torture and mayhem. according to the prosecutors, oliver got in a fight with his girlfriend over which laundromat to use. in solano counted the trucker killed necessary fiery crash in vallejo is identified as william ballard of roseville. the chp says his ace hardware truck hit a pickup and flew off an overpass above highway 37

yesterday morning. witnesses pulled ballard out of the truck. but he later died. the other driver was not seriously hurt. that bar pilot in charge of that oil tanker that bumped one of the bay bridge towers this week was sober at the time. an attorney for captain guy kleess says all drug and alcohol tests have come back negative. kleess is an experienced navigator who has had a few minor scrapes over the years. the cause of monday's bump still under investigation. 5:09. let's check the traffic. >> giann? >> we have construction in the south bay on 880. southbound near bascomb and coleman, looks like it will be wrapped up in the next 30 minutes but you might see some slight delays there. the rest of the south bay checking in problem-free. just construction there near coleman and bascomb. elsewhere, eastbound highway 4 that roadwork they had a full freeway closure near loveridge. it is late running. so they are in the stages of wrapping that up there. westbound we are seeing some slight delays but overall "friday light" and no delays on

passengers and the flight crew alike. you can see the python hitching a ride on the wing -- look at that! it shocked passengers and the flight crew. one person said, you have to be kidding me! it didn't interrupt flight operations but it was found dead on arrival. a chilly flight. but it hung on. >> i think i just got the chills. >> all right. an indiana boy kidnapped 19 years ago has been found. it turns out his grandparents were behind the disappearance. richard wayne landers, jr., has been living in minnesota and investigators say landers' paternal grandparents didn't want the courts to award custody to his mother so they abducted him. last september he was tracked down through his social security number. >> the young man living in the state of minnesota actually was using his social security number but what was really interesting was that doing further checking on his personal logs he had the same date of birth as the boy who was listed as missing in 1994. >> the grandparents were

charged with a felony in 1999, but that was dropped after the case went cold. investigators say they can't file charges now because the statute of limitations has expired. meanwhile, landers is now 24 and married. bart police say they caught a serial bike bandit. 57-year-old marque moore a felon on parole was convicted of stealing stations at bart stations. stolen items were found at his home. he was caught with the help of one of his victims. >> he had seen his stolen bicycle on craigslist so he agreed to meet with the suspect at our ashby bart station. so he gave bart police a call and said, this is what's going to be happening and bart police met him there and the rest is history. >> they got their man. bart police have set up a web page with the stolen bikes so if you lost a bike, check it out. 5:15. i told you i was driving along the embarcadero and looked at the bay bridge and the lights were on. >> the lights were on.

>> yeah. >> i missed the whole show. >> on ha of the bridge. >> i bet it was beautiful. let's jump to some mass transit conditions right now. so far, so good. no delays on bart. good news there. ace, muni, caltrain, ferries problem-free. so if you doesn't feel like hitting the freeways, you're good to go with mass transit. over to the freeways we go. so far traffic is actually okay right now. if you are working your way along 80 eastshore freeway no delays through there. it's about 19 minutes from the carquinez bridge to the maze. we started off eastbound 80 at ashby with construction but all lanes are open good to go both directions. 880 not bad northbound clear, southbound no delays through hayward. also 880/237 connector in milpitas, looks like traffic looking good westbound 237 between 880 and 101. no delays there. 880 southbound near bascomb and coleman reports of some

construction still there so some slight delays approaching the scene. let's get a live look at 580. westbound extra volume but still "friday light." and really "live look at the bay bridge toll plaza. so far, so good looks like we're not seeing any delays just yet, elizabeth. >> thank you, gianna. we are getting reports of temperatures now in the upper 20s. you need clear calm conditions for these temperatures to go lower. 28 in fairfield. so once again those freeze warnings, frost advisories still in effect for the next several hours from 8:00 this morning. otherwise the rest of the bay area we are seeing a lot of 30s to low 40s. mid-30s in consumer report. 36 right now in livermore. and 38 in santa rosa. so the winds have kept temperatures slightly warmer. but once again, the frost advisories are mainly around the bay and the freeze warnings are for those inland valleys in the north bay, santa clara valley and east bay interior valleys. it won't warm up this

afternoon. we are expecting partly sunny skies, kind of similar to yesterday struggling to get into the very low 50s. a lot of upper 40s, as well. that's your high. so these are going to be a couple of cold days but dry. all those slight snow showers a little dusting in the santa cruz mountains in the rain that kind of was there a little bit yesterday morning that's now all moved farther south so we are watching a little bit of unsettled weather off the cost but looks like for saturday right now we are keeping any rain chances out of the forecast. and then a ridge of high pressure really begins to build on sunday. and we're looking at crystal clear skies and plenty of sunshine through next week. so forecasted highs for today once again upper 40s, low 50s. 53 in oakland. 51 in fremont. and here's a look at your forecast. over the next several days, yeah, kind of quiet except for those really cold mornings. by the way they already have the freeze warnings and the frost advisories in effect for tomorrow morning, as well. could be the coldest temperatures of the season so far and then sunshine monday

through thursday. >> all right. we like sunshine. >> we do. but it's still going to be cold. no 60s. >> i was just looking at the forecast on the east coast in boston. they are in the 50s out there right now. we're freezing here. >> that's not too bad. >> what's up with that? >> i know. >> thank you, elizabeth. in this morning's healthwatch, changes are coming for some of america's most popular sleeping pills. turns out, they work a bit too well. the fda is requiring makers of ambien and similar sleeping pills to lower the dosages. the problem, increased risk of injury due to morning drowsiness. specifically, we're talking car accidents. regulators want the recommended dosage cut in half for women. well, the flu is spreading fast and now the makers of vaccine and tamiflu is running short. the west coast so far and california not one of the states that are running short. there is an overlap between symptoms in cold and flu but

dr. kim says it comes down to timing. >> i'd say the best way to tell the two apart is with the flu symptoms hit you like a mack truck. suddenly out of the blue you might have a high fever, over 102. you feel muscle aches, overwhelming fatigue. you feel lousy. >> some doctors say this season looks bad because last year was unusually mild and the main strain of influenza this year tends to make people sicker. i know lawrence -- he got hit with a mack truck. >> he did. he was fine and then boom. >> i hope he feels better very soon. >> coming along. it's 5:20. tomorrow, of course, the 49ers take on the packers. >> yeah. we have a big game. our bet with the morning anchors in green bay. it's a good one, coming up.

killed a teenaged boy. >> cbs 5 reporter cate caugiran is in marin where the victim's sister says this is a case of mistaken identity. cate. >> reporter: we spoke to the victim's sister a few moments ago but right now as far as the investigation is concerned, deputies are interviewing witnesses to piece together how this happened and at this point, they do not have a suspect description. but we can tell you that deputies say around 12:16 they received multiple 911 calls from the 300 block of drake avenue and once they got here they found a 17-year-old boy with multiple gunshot wounds. deputies say he was surrounded by several witnesses, one was trying to save him. but it was no use. authorities tried to administer cpr but a short time after, they pronounced him dead. we spoke with the boy's sister. she tells us he turned 17 just four days ago. >> killed my baby brother. >> happened for nothing. happened for absolutely nothing because i know, happened for nothing basically. somebody just got the wrong

thing, got it confused. they didn't know him. he's not from out here. >> reporter: his sister says he was a high school student visiting from weed, california. investigators are working on piecing together the details of what happened before the shooting. we know this is the first homicide for marin city and we are told that deputies will be here on scene throughout the morning. cate caugiran, cbs 5. a freeze warning is now in effect in the bay area. the warning covers the north bay valleys until 8:00 this morning. a frost advisory has been issued for the south bay. in livermore people bundled up for bone-chilling temperatures, in the 30s right now. >> definitely making sure to have gloves and hat. >> got the jacket, two shirts and t-shirts. seems to be colder. seems colder this year than last year. >> the cold snap is expected to linger into the weekend. >> i hear 20s now. >> yeah. right. who told you that? >> we have some upper 20s now in fairfield and napa so it is below freezing in some spots. the winds have kept temperatures slightly warmer in some parts of the bay area. but some parts are definitely under the freeze. it is cold out there. you will notice that flag by the bay bridge blowing in the breeze right now. it's blustery but that 28- degree reading right now in fairfield. otherwise, we are seeing 40s in san francisco. napa is chilly, as well. san francisco 44. fairfield 28 degrees. the freeze warnings and frost advisories are still in effect. the national weather service is keeping them in effect until 8 a.m. we have to closely monitor the winds. you need clear calm conditions for temperatures to really get cold overnight. they have already been posted for tomorrow morning by the way, as well. we could see our coldest temperatures of the season. by this afternoon, we are going to warm up. not a lot. still going to be cold. kind of similar to what we saw yesterday struggling to get out of the 50s. 51 -- struggling to get out of

federal regulators are now ordering a comprehensive review of boeing's 787 dreamliner aircraft. cbs 5 reporter anne makovec reports the decision comes as one of the planes is scheduled to touch down in san jose later this morning. anne joins us with more on that. good morning. >> reporter: good morning. this is supposed to be a celebratory morning here at the san jose international airport because this is the first 787 to be flying from the bay area. and i just checked the flight schedule. it is set to leave san jose at 11:55 this morning. that is a 10-minute delay. we'll hear more from the faa this morning in a news conference. the first boeing 787 dreamliner aircraft to fly from the bay area is set for this morning. it's run by all nippon airways from japan. this model has been flying for about a year. just before 4 a.m. this morning, the faa ordered that comprehensive review of critical systems in this model after a fire and fuel leak

alameda county deputies say the owner now faces animal cruelty charges. mr. teeth, a dwarf caiman that looks like an alligator, arrived at the oakland zoo after the pot bust on wednesday. he died overnight. the reptile's owner was under arrest for marijuana possession charges. in other bay area headlines, a public memorial will be held tomorrow morning in petaluma for alyssa byrne. the 19-year-old died after leaving a music festival alone in south lake tahoe on new year's eve. her body was found in a snow bank and an autopsy found no signs of foul play. tomorrow's service happens at 10 a.m. in the gym of casa grande high school where byrne graduated in 2011. this morning, the man accused of abducting his children and taking them on a stolen yacht will be back in court. he will appear at a policemen hearing. authorities say that last september he kidnapped his two children from their mother and took them out to sea. the coast guard found them off the coast of monterey three days later. and if you would like to
